Terms and conditions for using near2u.net and its associated web sites

Definitions

1. This web site is owned and operated by Near2u Limited henceforth referred to as "the company"

2. Persons, groups, businesses, or companies who advertise or order web links within the company's web site are henceforth referred to as "the client"

3. Individuals who browse and use the web site or any of its links are henceforth referred to as "the surfer"

The Company's Liability

1. The company does not accept any liability for advertisements or linked web sites or for the products or services advertised therein. 

2. The company accepts all advertising and web links on condition that the person, persons or company who submit them accept total liability for their content.

3. The company reserves the absolute right to refuse or withdraw advertisements or web links from its web pages without notice or explanation.  In the event of this happening the company's maximum liability will be restricted to the total amount of advanced fees paid but not realised.

4. In the event that advertisements or web links are withdrawn because the client has contravened the companies terms and conditions no refund for unrealised advertising will be given.

5. The company is not an internet service provider so, whilst the company strives to ensure complete continuity of service, it does not guarantee such continuity.  In the event that service is interrupted, for whatever reason, the company accepts no liability whatsoever and will not compensate for lost advertising time.

6. Whilst every effort is made to ensure that all material produced is accurate in every detail the company does not accept any liability for text or layout errors no matter howsoever caused.

The Client's Liability

1. The client is solely responsible for the content and accuracy of all the client's advertising material and is liable in totality for any claims resulting from inaccurate or misleading information provided within such advertising.

2. The client accepts that no web links or advertising material relating to a third party will appear on the clients web site without the company being notified.

3. The client confirms that in the event of advertising or web links appearing on the clients' site a fixed charge will be made for the advertising and/or web links. Such charges will be as laid down in the company's published price list in force at the time.

4. The client confirms that he/she/they will not advertise services that the client cannot provide or sustain in the manner or geographic area that they are advertised.

5. The client confirms that he/she/they will not advertise products that the client cannot provide or service in the quality, manner or geographic area that they are advertised.

6. The client will not advertise any product or service that is likely to cause offense to any segment of the population or advertise an acceptable product in a manner that might do likewise.

7. The client confirms that he/she/they will not advertise any product that is unlawful or not legally their property.

8. Clients using near-buy.net confirm that, with regard to the product that they are advertising, they are private citizens not engaged in the commercial sale of such products. The exception to this is for commercial clients who have purchased a web link within near-buy.net,

9. In submitting an advertisement clients accept that their details will be held on the company's files for future reference as defined by Data Protection Act.

The Surfers Liability

1. In accessing and using the site the surfer accepts the company's terms and conditions

2. In responding to the clients' advertising the surfer accepts full responsibility for any decisions taken as a result of the advertising

Contravention of the term and conditions

1. In the event that the client contravenes the terms and conditions above, all advertising and web links will be removed immediately and without notice or compensation.

2. In the event that a surfer has a complaint about a client, evidence concerning the client's contravention of the company's terms and conditions must be emailed to the company within 7 days of the contravention.

Acceptance

1. In authorising or placing an advertisement or web link with the company, the client confirms complete acceptance of the terms and conditions as published on the company' web site.

2. In using the company's website the surfer accepts the company's terms and conditions and affirms that the company has no liability whatsoever for the products and services advertised.
